Florida Man Sues Prominent Clearwater Resort Over Negligence After Slip-and-Fall Incident

A Florida man has filed a lawsuit against a prominent resort, alleging negligence after a slip-and-fall incident that resulted in serious injuries. The complaint was filed by Massoud Dabiri on June 19, 2024, in the Sixth Judicial Circuit Court in Pinellas County, Florida, against Sandpearl Resort, LLC.

According to the court documents, Dabiri claims that on April 10, 2024, he was an invitee at the Sandpearl Resort located at 500 Mandalay Ave, Clearwater, FL. While exiting a restroom adjacent to the pool area, he slipped and fell due to water on the floor. Dabiri asserts that the resort negligently maintained its premises by allowing a hazardous condition to exist.

The plaintiff alleges that Sandpearl Resort had a non-delegable duty to maintain its premises in a reasonably safe condition and to warn guests of any potential dangers. The complaint states that the resort breached this duty by permitting water to remain on the restroom floor and failing to provide adequate warnings or take remedial action. "The Defendant had actual or constructive knowledge of the dangerous condition and took no action to remedy it," reads one part of the filing.

Dabiri's lawsuit outlines several specific accusations against Sandpearl Resort: allowing a foreign substance (water) to exist on the floor, failing to properly warn guests of this hazard, not providing a non-skid surface, and neglecting to dry the floor adequately. As a result of these alleged failures, Dabiri claims he suffered significant injuries including pain, medical expenses, mental anguish, physical handicap, loss of earnings and earning capacity, loss of enjoyment of life, and aggravation of pre-existing conditions.

The plaintiff is seeking damages exceeding $50,000 along with interest and costs. He also demands a jury trial for all triable issues related to this case.
