A Miami-Dade County resident has filed a lawsuit against a Boca Raton hotel, alleging negligence that led to severe injuries. Jeffrey John Kusmierski lodged the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on June 9, 2024, targeting BRH Plaza LLC, which operates as Boca Raton Plaza Hotel & Suites.
According to the court documents, Kusmierski was an invitee at the Boca Raton Plaza Hotel & Suites on June 10, 2023. He claims that while walking on the property located at 2901 N. Federal Highway in Boca Raton, he tripped over loose brick pavers in the walkway and suffered significant injuries. The plaintiff argues that the hotel had a duty to maintain its premises in a reasonably safe condition and to warn guests of any dangerous conditions.
Kusmierski asserts that BRH Plaza LLC failed to uphold these responsibilities by allowing the loose brick pavers to remain unfixed despite knowing—or having reason to know—about their hazardous state through reasonable inspection. "Defendant breached its duty by allowing an unreasonably dangerous condition to exist," states the complaint. It further accuses the hotel of not repairing or warning about this danger, leading directly to Kusmierski's fall and subsequent injuries.
The lawsuit details various consequences of Kusmierski's fall, including pain and suffering, disability, disfigurement, loss of enjoyment of life, and substantial medical expenses. The plaintiff contends that these damages are either permanent or ongoing and will continue to affect him in the future.
In his filing, Kusmierski seeks judgment for damages exceeding $50,000 plus costs associated with prosecuting this action. He also demands a trial by jury.
