Nancy Watson, the plaintiff, lodged her complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida on April 8, 2025. The defendant in this case is Tytaden Trucking, LLC.
The legal action stems from an incident that occurred on April 12, 2021. Nancy Watson had purchased a new refrigerator from Home Depot and was awaiting its delivery to her condominium in Greenacres, Palm Beach County. The delivery was handled by Tytaden Trucking, LLC, which was responsible for transporting goods for various retailers in South Florida at that time. According to the complaint, three workers from Tytaden Trucking were tasked with delivering the refrigerator to Watson's second-floor condo unit.
The situation took a dangerous turn when the workers attempted to maneuver the appliance up a flight of stairs leading to Watson's front door. As they repositioned themselves on the staircase landing, they lost control of the refrigerator and dolly. The heavy appliance tumbled down the stairs and struck Watson, pinning her against a wall and causing significant injuries.
Watson's lawsuit claims that Tytaden Trucking owed her a duty of care during the delivery process but failed to uphold it by not securing the refrigerator properly as it was moved up the stairs. This alleged negligence resulted in bodily harm to Watson and caused her considerable pain and suffering. The complaint details various consequences she faced due to this incident: disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings capacity, and aggravation of pre-existing conditions.
In seeking justice through this lawsuit, Nancy Watson demands judgment against Tytaden Trucking for damages exceeding $50,000 along with taxable costs and interest on liquidated damages. She also requests any further relief deemed permissible under Florida law and has demanded a jury trial for all triable issues.
