Palm Beach couple sues chiropractor for alleged medical negligence leading to permanent nerve damage

A Palm Beach County couple has filed a lawsuit alleging severe medical negligence that resulted in permanent nerve damage. On June 3, 2024, Cheryl White-Holt and her husband Alan Holt filed a complaint against Michael R. Tramontana, DC, and his professional association in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida.

The plaintiffs claim that on March 25, 2022, Cheryl White-Holt underwent an acupuncture treatment administered by Dr. Michael R. Tramontana at his Delray Beach clinic. During the procedure, Dr. Tramontana allegedly inserted needles into Cheryl's ankle and other areas of her body improperly, causing immediate discomfort and subsequent severe trauma to her left leg and ankle. The complaint states that Cheryl experienced significant pain shortly after the treatment and was later diagnosed with permanent tibial nerve damage by multiple healthcare providers.

According to the lawsuit, Cheryl requested her medical records from Dr. Tramontana’s office twice—once in May 2023 and again in December 2023—but was informed that no such records existed. This failure to maintain proper medical documentation is cited as a violation of Florida Statute §766.204 and is claimed to have hindered Cheryl's ability to substantiate her case further.

The Holts' attorney argues that this lack of documentation constitutes evidence of negligence in both the administration of acupuncture treatment and record-keeping practices at Dr. Tramontana’s clinic. The complaint references several medical evaluations from subsequent healthcare providers who concluded that the nerve damage was likely caused by improper needle insertion during the acupuncture session.

In addition to seeking damages exceeding $50,000 for medical expenses, pain and suffering, loss of earning capacity, and other related costs, Alan Holt is also claiming loss of consortium due to his wife's injuries. The plaintiffs are demanding a jury trial for all issues so triable as a matter of right.
