Plaintiff alleges nursing negligence against Sonata Senior Living for broken leg

On May 30, 2024, Roberta Lieberman filed a nursing negligence complaint against Sonata Senior Living, LLC, doing business as Sonata Assisted Living Memory Care Boca Raton. The complaint was filed in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida.

Roberta Lieberman alleges that during her residency at Sonata Senior Living from August 4, 2021, she suffered significant injuries due to negligent care by the facility's nursing staff. According to the complaint, Ms. Lieberman was diagnosed with dementia upon admission and was identified as a "fall risk" based on her health assessment conducted by Sonata’s staff. Despite this assessment, the plaintiff claims that the facility failed to implement adequate precautions to prevent falls and provide necessary medical care.

The complaint details several incidents highlighting alleged negligence. On February 23, 2022, Ms. Lieberman developed a stage two pressure ulcer at her coccyx. A week later, on March 1, 2022, she complained of right leg pain; subsequent x-rays revealed a right leg fracture. Nursing notes indicated no report of a fall had been received and an investigation was promised but allegedly not followed through adequately.

The lawsuit names specific nursing personnel involved in Ms. Lieberman's care including Jennifer Freund, L.P.N., Chevanese Burnis, L.P.N., Jean Judith, L.P.N., Carline Fleury, L.P.N., Juliet McRae, L.P.N., Judene Pawlaczyk, L.P.N., and Cora Williams, L.P.N. It asserts that these individuals were either employees or agents of Sonata Senior Living and acted within their scope of employment while providing care to Ms. Lieberman.

Ms. Lieberman accuses Sonata Senior Living of failing to meet the standards of care required under Florida Statutes §400.023 and §429.28 et seq., which govern nursing home operations and resident rights respectively. She claims that the facility's negligence resulted in serious bodily injury causing pain and suffering, disfigurement, mental anguish, loss of enjoyment of life, medical expenses for hospitalization and treatment aggravating her pre-existing conditions.

The plaintiff seeks judgment against Sonata Senior Living for all damages allowed by law including compensation for physical pain and suffering endured due to the alleged negligence.
