Clearwater resident sues local restaurant over negligence leading to severe injuries

In a recent court filing, Timothy Beynon has lodged a negligence complaint against Proino Breakfast Club, Inc., a Florida-based profit corporation. The complaint was filed on May 28, 2024, in the Circuit Court of the 6th Judicial Circuit in and for Pinellas County, Florida.

Beynon, a resident of Clearwater, FL, alleges that he suffered significant injuries due to the negligent maintenance of the premises owned and operated by Proino Breakfast Club at 1700 S Missouri Ave, Clearwater. According to the complaint, Beynon visited the property as a business invitee on August 26, 2023. During his visit, he tripped and fell on an uneven floor surface—a hazard he claims was created and left unaddressed by the defendant.

The lawsuit outlines several key points of negligence attributed to Proino Breakfast Club. Beynon asserts that the company failed to maintain its grounds in a reasonably safe condition, thereby creating a dangerous environment for patrons. Furthermore, it is alleged that Proino Breakfast Club neglected to correct this hazardous condition despite having—or should have had—knowledge of its existence through reasonable care. Additionally, Beynon contends that there were no adequate warnings provided about the dangerous condition on the premises.

The complaint details how these alleged acts of negligence led to severe consequences for Beynon. He claims to have suffered bodily injury resulting in pain and suffering, disability, disfigurement, mental anguish, and aggravation or acceleration of pre-existing conditions. The injuries also purportedly caused loss of capacity for enjoyment of life and incurred expenses related to hospitalization and medical care. Moreover, Beynon alleges that his ability to earn money has been compromised both in the past and future due to these injuries.

In seeking redress from the court, Beynon demands judgment for damages exceeding $50,000 but remains uncertain if it surpasses $75,000. He is also requesting compensation for costs associated with this legal action along with any other equitable and legal relief deemed appropriate by the court. Additionally, Beynon has demanded a trial by jury for all issues triable as such.
