In a recent court filing, Adria Mejeras has lodged a negligence complaint against OakPark Operations, LLC. The complaint was filed on May 29, 2024, in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida.
The lawsuit stems from an incident that occurred on June 7, 2023, when Mejeras tripped and fell on an uneven sidewalk owned and maintained by OakPark Operations. According to the filing, Mejeras was lawfully present on the premises located at 2851 Tampa Road, Palm Harbor, Florida. The plaintiff asserts that she was traversing the sidewalk between the parking lot and a nursing home when her foot caught an uneven surface, causing her to lose balance and fall. This fall resulted in significant injuries and damages.
Mejeras alleges that OakPark Operations failed in their duty to maintain the sidewalk in a reasonably safe condition. The complaint outlines several points of negligence including failure to adequately inspect or maintain the sidewalk area, failure to warn of potential hazards, and failure to correct known dangerous conditions. Specifically, it states: "OakPark breached the duty owed to the Plaintiff by negligently failing to maintain or adequately maintain the sidewalk area where Plaintiff fell in a reasonably safe condition free of trip hazards."
The plaintiff further contends that these failures directly led to her injuries which include permanent bodily harm, pain and suffering both physical and mental, disability, disfigurement, mental anguish, inconvenience, loss of capacity for enjoyment of life among other damages. The complaint details how these injuries have caused significant financial burdens due to medical expenses and loss of earnings.
Mejeras is seeking damages exceeding $50,000 exclusive of costs, interest, and attorney fees. She requests a trial by jury for all issues triable as of right by a jury.
