Plaintiff Alleges Negligence Against Vehicle Owner and Operator Following Collision

In a recent court filing, Norma Campero has lodged a negligence complaint against Tessie Lambert Weidmann and Malvin Herbert Lambert. The complaint was filed on May 23, 2024, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida.

The case revolves around an incident that occurred on March 23, 2023. According to the complaint, Malvin Herbert Lambert owned a motor vehicle that was being operated by Tessie Lambert Weidmann with his consent. The vehicle was involved in an accident at or near N. Highland Ave and S. Sunset Point Rd in Florida, where it collided with Norma Campero. Campero alleges that Weidmann negligently operated or maintained the vehicle, leading to the collision.

Campero's complaint outlines significant damages she claims to have suffered as a result of the accident. She states that she endured bodily injury, including permanent injuries, pain and suffering both physically and mentally, disability, physical impairment, disfigurement, mental anguish, inconvenience, loss of capacity for enjoyment of life, aggravation of existing conditions, and various medical expenses. Additionally, she claims her motor vehicle was damaged in the incident.

In her lawsuit against Tessie Lambert Weidmann for negligence (Count I), Campero seeks judgment for damages exceeding $50,000. She demands compensation for costs related to hospitalization and medical care, loss of earnings and earning capacity, as well as other relief deemed appropriate by the court. Furthermore, she requests a jury trial on all triable issues.

The complaint also holds Malvin Herbert Lambert vicariously liable under Florida’s dangerous instrumentality doctrine (Count II). This legal principle asserts that owners of vehicles can be held responsible for damages caused by those who operate their vehicles with permission. As such, Campero seeks similar compensatory relief from Lambert for his role as the vehicle owner.

Representing Norma Campero is attorney Paul Lazaro from Morgan & Morgan in Tampa. The case has been assigned Case Number 24-002288-CI and will be presided over by judges from the Sixth Judicial Circuit Court in Pinellas County.
