Rufus Williams has filed a negligence complaint against UDR Okeeheelee LLC, doing business as The Reserve and Park at Riverbridge, and UDR, Inc. The complaint was filed on May 20, 2024, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida.
The plaintiff, Rufus Williams, alleges that on March 1, 2023, he suffered severe bodily injuries due to inadequate lighting in the common areas of the apartment complex located at 633 Parkway Court, Greenacres, Florida. According to the complaint, Williams resided at the apartment complex and was descending the stairs when he missed a step due to poor visibility caused by non-functioning building and hallway lights. This incident led to his fall and subsequent injuries.
Williams asserts that both defendants had a non-delegable duty to maintain safe conditions within the common areas of their property. He claims that UDR Okeeheelee LLC and UDR, Inc. failed in their duty by not ensuring adequate lighting and failing to warn residents about the hazardous condition. "Defendants had actual knowledge or should have known of these dangerous conditions due to their regularity," states the complaint.
The plaintiff's counsel argues that this negligence resulted in serious injuries for Williams. He sustained physical handicaps, disfigurement, mental pain and suffering, loss of income both past and future, loss of capacity for enjoyment of life, and incurred significant medical expenses. The complaint highlights that these injuries are permanent and will continue to affect Williams' quality of life.
Williams is seeking judgment against both defendants for an amount exceeding $50,000 plus costs. Additionally, he demands a trial by jury for all issues triable as a matter of right.
