Woman sues The Village at Bentley Park Homeowners' Association for negligence over trip hazard

In the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, plaintiff Katarzyna Cikowska has filed a lawsuit against The Village at Bentley Park Homeowners’ Association, Inc. The case, identified as 24-001990-CI and filed on May 6, 2024, alleges negligence and breach of contract by the defendant.

According to the complaint, Cikowska owns a condominium and an assigned parking spot at 2411 Bentley Drive in Palm Harbor. On June 12, 2020, she sustained permanent injuries to her knee after tripping over an unrepaired area in her parking space. Her attorney, Lawrence H. Liebling, asserts that the association failed to maintain the common areas as required by their Declaration of Covenants and Restrictions.

The damages claimed include bodily injury, pain and suffering, disability, disfigurement, loss of enjoyment of life, medical expenses, loss of earnings, and aggravation of a pre-existing condition. The plaintiff is seeking damages exceeding $50,000 for both negligence and breach of contract.

Cikowska demands judgment for damages against The Village at Bentley Park Homeowners’ Association along with a jury trial.
