In the Circuit Court, Sixth Judicial Circuit, Pinellas County, Florida, a lawsuit was filed on May 1, 2024 (Case Number:24-001919-CI) by plaintiff Marlon Dunn against defendants Christopher Mickler, D.O., and Morton Plant Hospital Association, Inc. The complaint alleges negligence resulting in severe bodily harm.

Represented by attorney Vin W. Moore of Farah Land Farah, P.A., Mr. Dunn alleges that he suffered complete paralysis below his waist due to the negligence of Dr. Mickler and Morton Plant Hospital. On April 21, 2022, Mr. Dunn sought medical care at Morton Plant Hospital for a spinal cord stimulator insertion but was allegedly subjected to substandard care.

Specifically, the complaint accuses Dr. Mickler of failing to order necessary imaging studies and timely treatment for Mr. Dunn's spinal cord compression which resulted in his paralysis. As a result of this alleged negligence, Mr. Dunn claims damages exceeding $50,000 including bodily injury, pain and suffering, disability, disfigurement, mental anguish and medical expenses.

Mr. Dunn is seeking judgment for compensatory damages and costs of this action against both Dr. Mickler and Morton Plant Hospital Association Inc., alleging vicarious liability on part of the hospital for the actions of its agent Dr. Mickler.
