Vicki McMullen sues Palm Garden of Pinellas for negligence and violation of resident rights

In a lawsuit filed in the Circuit Court of Pinellas County, Florida, plaintiff Vicki McMullen is suing Palm Garden of Pinellas, LLC (case number 24-001747-CI), dated April 18, 2024. The complaint alleges negligence and violation of resident rights by the defendant.

McMullen was a resident at Palm Garden of Pinellas from June 15 to July 14, 2023. She had been admitted for short-term rehabilitation post hospitalization for left knee replacement and required the use of a wheelchair. The defendant is accused of not meeting minimum standards for nursing home operation as per Chapter 400, Florida Statutes and Florida Administrative Code 59A-4.

The plaintiff's counsel has certified that an investigation was conducted which led to a belief that there have been residents rights violations and negligence in McMullen's care and treatment. McMullen seeks damages in excess of $50,000 exclusive of interest and costs.
