William H. Jennings III sues Pampa Sunbelt 15 for unauthorized removal of mature trees

In the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, William H. Jennings III has filed a lawsuit against Pampa Sunbelt 15, LLC, Nelson Construction and Renovations, Inc., and Oneils LLC (d/b/a O’Neils Tree Service). The case number is 24-001403-CI and was filed on March 28, 2024. The suit alleges unauthorized removal of mature trees from Jennings' property by the defendants.

Jennings, represented by an unnamed counsel, alleges that he became the owner of a property in Pinellas County on August 23, 2016. This property contained several mature trees which were an average height of about thirty feet tall. Pampa Sunbelt 15, LLC acquired adjacent property on August 9, 2022 and hired Nelson Construction to build townhomes there.

Nelson Construction installed a fence along the lot line to separate the two properties and presented a Tree Plan to the City of Clearwater for removing certain trees from their construction site. However, in July 2023, at Nelson Construction’s behest, O’Neils began unauthorized removal of nine trees and fifteen shrubs from Jennings' property.

Jennings is seeking damages exceeding $50,000 exclusive of costs, interest, and attorney’s fees. He alleges that these actions have caused significant harm to his property and have been carried out without necessary approvals from relevant authorities.
