Gerardo sues Kilgore Construction for negligent operation causing serious bodily injury

Gerardo Canezo and Wanda Canezo have filed a lawsuit against Kilgore Construction, LLC, and Kevin DeAugustine in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida. The case number is 24-001366-CI and was filed on March 26, 2024. The suit seeks damages in excess of $50,000 for negligence resulting in serious bodily injury.

The plaintiffs allege that on April 12, 2022, at approximately 10:43 am., Kevin DeAugustine negligently operated a motor vehicle owned by Kilgore Construction, resulting in a collision with a parked vehicle where Gerardo Canezo was a passenger. Wanda Canezo claims loss of consortium due to her husband's injuries.

The plaintiffs are seeking compensation for their injuries and losses including pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, medical expenses, lost wages and loss of earning capacity. They also argue that under Florida's Dangerous Instrumentality Doctrine, Kilgore Construction should be held liable as the owner of the vehicle involved in the accident.
