Geoffrey L. Singer sues Silverstone Harborchase PBG Operating LLC for negligent care resulting in severe injuries

In the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, Geoffrey L. Singer, acting as Durable Power of Attorney for Barbara R. Singer, has filed a lawsuit against Silverstone Harborchase PBG Operating LLC and Harbor Palm Beach Gardens Management LLC. The case number is 502024CA002958XXXAMB Div: AN and was filed on March 29, 2024.

The plaintiff alleges that while Barbara R. Singer was a resident at the defendants' facility, she was subjected to negligent care which resulted in multiple falls causing severe injuries including a fractured femur requiring surgery. The complaint further states that this is an action for damages exceeding $50,001 exclusive of costs, interest and attorneys’ fees.

The plaintiff asserts that he has complied with the pre-suit process by filing a Notice of Intent to Initiate Litigation based on reasonable investigation leading to a good faith belief that grounds exist for an action against the named defendants. He also contends that this case is not subject to arbitration due to several reasons including lack of valid signed Arbitration Agreement applicable to all parties and voluntary signing among others.

The plaintiff seeks judgment against the defendants for violation of Chapter 429 of the Florida Statutes relating to Assisted Living Facility Negligence Claim and residents' rights violations pursuant to Florida Statute §429.28.
