Lawsuit filed over 3-year-old's broken leg during fireworks mishap in Tallahassee

TALLAHASSEE - A Tallahassee family sued its apartment complex after its three-year-old daughter's leg was broken in a freak fireworks accident, according to documents filed Feb. 22 in the Leon County Circuit Court. 

Plaintiffs Tamara Hughes and Desmond McNealy are the parents of Sy'mantha McNealy, who was with her family in their apartment at the complex owned by Leon Arms LLC and managed/maintained by Orange State Construction Inc on Holton Street at the time of the incident. 

On Dec. 26 2020, Desmond McNealy asked people outside of his apartment to stop shooting fireworks in such a close proximity, an issue that was an ongoing concern at the complex, the suit says.

The individuals with the fireworks then allegedly verbally assaulted Desmond, who attempted to call law enforcement. In retaliation, the individuals shot fireworks in the direction of Desmond and his apartment, the suit says.

Sy'mantha, who was inside the apartment, was shot twice by fireworks, causing a fracture in her femur, the suit says.

The defendants are sued for one count each of negligence, and plaintiffs are seeking damages in excess for their daughter's injury, medical bills, mental and emotional anguish and litigation fees.

Sy'mantha's family is represented by the Law Office of Matthew C. Williams, PLLC, of Tallahassee.
