St. Petersburg homeowner seeks insurance for property loss

CLEARWATER — A St. Petersburg property owner is suing an insurance company, alleging breach of contract.

Tammy Franklin filed a complaint Sept. 21 in Pinellas County Circuit Court against Heritage Property and Casualty Insurance Company, alleging failure to provide insurance benefits.

According to the complaint, between Sept. 20, 2016, and Sept. 20, 2017, during the policy period, Franklin's property at 519 53rd St. S., St. Petersburg, sustained a covered loss due to water damage. Franklin says she timely notified Heritage of the damage and the defendant assigned a date of loss. 

Despite complying with all conditions precedent to entitle her to recover under the policy, the suit says, Franklin continues not to receive any insurance coverage. 

The plaintiff alleges Heritage Property and Casualty Insurance has failed to provide coverage for the losses and failed to pay all of Franklin's losses.

Franklin seeks trial by jury, more than $15,000 in consequential damages, plus attorney fees and costs. She is represented by attorneys Bradford L. Stewart and Aruna Nankissone of The Nation Law Firm LLP in Lakeland.
