Orlando homeowners allege they were deprived of insurance coverage

ORLANDO — Two Orlando homeowners are suing an insurance company, alleging breach of contract.

Peggy Rolon and Orlando Rivera filed a complaint Aug. 23 in Orange County Circuit Court against Universal Property & Casualty Insurance Company, alleging the defendant constructively denied the plaintiffs’ claim for hurricane damages.

According to the complaint, on Sept. 11, 2017, Rolon's and Rivera's insured property at 6969 Edgeworth Drive, Orlando, sustained damages as a result of a windstorm from Hurricane Irma, causing substantial property damages and further insured losses. 

Rolon and Rivera allege they have submitted a timely claim and provided documentation of damages but were deprived of the coverage and other benefits afforded to them under the Universal Property insurance policy. 

The plaintiffs allege Universal Property & Casualty Insurance failed and refused to tender all insurance proceeds due and owing as a result of the covered loss and have failed and refused to adjust all losses as required by the policy.

Rolon and Rivera seek trial by jury, actual damages of more than $15,000, interest, costs, attorney fees, and any other appropriate relief. They are represented by attorney Justin Petrie of Kandell, Kandell & Petrie in Miami.
