Client alleges Wells Fargo refused to release funds

ORLANDO — An Orange County man is suing Wells Fargo, alleging breach of contract.

Steve Elliott filed a complaint Aug. 23 in Orange County Circuit Court against Wells Fargo Bank NA, alleging the defendant refused to released the plaintiff's funds from a CD account.

According to the complaint, in June, Steve Elliott contacted Wells Fargo to request it release the monies that remained in the CD account amounting to $36,000. However, Elliott says, he was told the account was flagged and that the monies in the account were being used to satisfy an unpaid debt owed to Wells Fargo by the corporation that he specifically never pledged as collateral for the corporation's debt. 

Accordingly, Elliott demanded that Wells Fargo release his funds immediately but the defendant allegedly has not responded directly to his request. 

The plaintiff alleges Wells Fargo Bank exercised dominion over the funds that were deposited into the Elliott's CD account without consent and contrary to the ownership interest.

Elliott seeks trial by jury, damages in excess of $15,000, plus attorney fees and court costs. He is represented by attorney Jerry Girley of Orlando.
