Orange County investor accused for breaching oral agreement

ORLANDO — Two Orange County individuals are suing an investor, alleging unjust enrichment.

Viviane Acarie and Mike Abel filed a complaint Aug. 20 in Orange Circuit Court against David Loos, alleging he breached their oral agreement by failing to comply with investment shares and returning the original amount of the investment.

According to the complaint, on June 15, 2015, Acarie and Abel verbally and mutually assented to enter into verbal contract, wherein they were requested to provide Loos $40,000 to invest in the purchase of silver. 

The suit says the agreement also specified that the plaintiffs were to receive a 5 percent dividend from the total investment but they have have failed to receive any dividends or prospects of investment despite their requesting to return their original investment from Loos. 

The plaintiffs allege Loos obtained funds from Acarie and Abel with the intent to permanently deprive them of their right to such money and that he appropriated the money for his own use.

Acarie and Abel seek trial by jury, compensatory damages in excess of $15,000 and all other just and proper relief. They are represented by attorney Divinne Smith of Joseph Smith PLLC in Orlando.
