Classic car owner alleges consignment shop failed to protect vehicle

ORLANDO — A Miami-Dade County classic car owner is suing an Orange County consignment shop, alleging breach of the consignment agreement.

Eric W. Boyer filed a complaint Aug. 15 in Orange County Circuit Court against Just Toys Classic Cars LLC, alleging the defendant failed to exercise reasonable care to protect the plaintiff's vehicle.

According to the complaint, on June 12, 2018, Boyer entered into a consignment agreement to consign his 2016 Ford Mustang with Just Toys Classic Cars. The lawsuit states the defendant agreed to pay Boyer $50, upon a successful sale of the Mustang.

However, as a result of the defendant's negligence, the suit says, Boyer's Mustang was stolen out of the Just Toys Classic Cars' showroom and has not been recovered. 

The plaintiff alleges Just Toys Classic Cars failed to maintain proper care and control of the vehicle and to keep it safe.

Boyer seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. He is represented by attorney Abbye E. Alexander of Quintairos, Prieto, Wood & Boyer PA in Orlando.
