Patient alleges nursing facility's negligence caused extreme pain

ORLANDO — A patient is suing nursing facility operators, alleging negligence and poor care.

Alvester Miller filed a complaint Aug. 15 in Orange County Circuit Court against 3920 Rosewood Way Operations LLC, doing business as Rosewood Health and Rehabilitation Center, Epsilon Health Care Properties LLC and Timothy Leonard, alleging violations of residents’ rights.

According to the complaint, on Aug. 21, 2017, Miller, 66, was a resident at the defendants' short-term skill nursing care facility following a surgical removal of an infected penile expander. As a result of the defendants'  poor care, the suit says, Miller experienced extreme pain, suffering and injury resulting pain and suffering, disability, disfigurement. 

The plaintiff alleges the defendants failed to provide the necessary care and services, and failed to appropriately monitor and recognize significant signs and symptoms of change in Miller's health condition.

Miller seeks trial by jury, damages in excess $15,000, exclusive of interest, attorney fees and court costs. He is represented by attorney Cassidy Perdue of Colling Gilbert Wright & Carter LLC in Orlando.
