Cement business alleges pool contractor owes $5,200

CLEARWATER — A cement manufacturing company is suing a Largo swimming pool contractor, alleging breach of contract in failing to pay more than $5,200.

Argos USA LLC filed a complaint Aug. 8 in Pinellas County Circuit Court against Sierra Stone & Aggregate Inc., alleging the defendant breached the verbal open account agreement by failing to remit payment for the invoices received.

According to the complaint, pursuant to a verbal open account agreement, Argos USA provided concrete goods and services from Sierra Stone in exchange for payment. 

Argos USA says it has failed to receive payment despite performing its obligation as agreed to and despite sending numerous demands for payment of the $5,211.17 owed. 

The plaintiff alleges Sierra Stone & Aggregate has failed and refuses to respond to Argos' demands although not denying the accuracy of the plaintiff s accounting.

Argos USA seeks trial by jury, judgment to recover the principal of $5,211.17, plus pre- and post-judgment interest, attorney fees, court costs, and all other just and proper relief. It is represented by attorney Jeffrey S. Leeper of Busch, Reed, Jones & Leeper PC in Marietta, Georgia.
