Clearwater property owners allege insurance company failed to cover water damages

CLEARWATER — Clearwater property owners are suing a liability insurer, alleging breach of an insurance contract.

Drywizard Drywall Services Inc., also known as Jeanna and Thomas Whitefield, filed a complaint Aug. 1 in Pinellas Circuit Court against Homeowners Choice Property and Casualty Insurance Company, alleging the defendant refused to reimburse the plaintiffs adequately for property damage.

According to the complaint, on July 20, 2017, the Drywizard Drywall Services property at 1567 Havana Drive, Clearwater, sustained water damage. At the time of the loss, the suit says, the property's Homeowners Choice insurance was in full force and effect. 

The plaintiffs allege Homeowners Choice Property and Casualty Insurance, despite demand for payments, has failed and refuses to pay the full value for all services related to the loss.

The plaintiffs seek trial by jury, damages of more than $15,000, exclusive of interest, costs and attorney fees and all other proper and appropriate relief. They are represented by attorney Guy H. Gilbert of Law Office of Guy H. Gilbert in Orlando.
