Pedestrian alleges St. Petersburg negligence caused her to fall

CLEARWATER — A Pinellas County woman is suing St. Petersburg, alleging negligence caused her to fall and suffer injuries.

Summer Benger filed a complaint Aug. 1 in Pinellas Circuit Court against the city of St. Petersburg, alleging the city failed to exercise reasonable care for the safety of the general public.

According to the complaint, on Nov. 27, 2016, Benger was walking from her vehicle onto the sidewalk near 550 Sixth St. S., St. Petersburg when she tripped and fell on a raised portion of the sidewalk. The suit says Benger was injured in and about her body and extremities and incurred medical expenses, pain and suffering and loss of ability to lead and enjoy a normal life. 

The plaintiff alleges the city of St. Petersburg failed to keep the sidewalks at or near the aforementioned location in a reasonably safe condition and failed to adequately warn the public of the danger of the raised portion of the sidewalk.

Benger seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. She is represented by attorney Steven A. Capriati of Morgan & Morgan PA in Tampa.
