Tourist blames Disney cafe for broken chair, injuries

ORLANDO — A Puerto Rican couple is suing a a Disney cafe, alleging negligence caused a broken stool that injured the wife.

Mariely Agosto, Robert Rivero, and the Conjugal Partnership filed a complaint July 30 in Orange County Circuit Cour against Estefan Enterprices Inc., doing business as Bongos Cuban Cafe at Downtown Disney West Side, alleging failure to maintain the premises in good and safe condition for the customers.

According to the complaint, on Feb. 20, 2015, Mariely Agosto was at defendant's cafe when she fell about 3 1/2 feet as a result of a defective or broken stool in the Pineapple Bar. After returning to Puerto Rico days after incident, the suit says, Agosto continued to experience pain in the lower back, hip and neck. 

As a result, the Agostos say they have suffered and continue to suffer emotional distress because of this unfortunate and avoidable incident. 

The plaintiffs allege Bongos Cuban Cafe failed to properly supervise the common areas in the cafe so as to furnish a safe seating area free from hazards for its customers.

The Agiostos seek trial by jury, judgment of $1 million for damages suffered, plus interest, costs and attorney fees. They are represented by attorney Julio E. Gil de of Bayamon, Puerto Rico.
