CLEARWATER — A disabled guest at Innisbrook Golf Resort & Spa in Palm Harbor is seeking damages and alleging serious injuries after an accident involving the scooter she was riding.
Theresa M. Lucas and Phillip L. Lucas filed a complaint on July 30, in the Pinellas Circuit Court against Salamander Innsibrook, LLC, doing business as Innisbrook Golf Resort & Spa, and John/Mary Does 1 and 2, resort and spa facility.
The couple alleges that the golf resort owners breached their duty to provide reasonable care for the security, safety and protection of their guests. The plaintiffs also claim that "insufficient measures" were taken to prevent injuries, according to the complaint.
The Lucases claim that during a a visit to the resort on July 31, 2014, Theresa fell backwards onto the handicapped lift platform owned and operated by the resort. She was seated on and riding her scooter when she fell, according to the complaint.
Plaintiffs claim the defendants' driver lowered the mobile scooter all the way to the ground instead of lifting the platform to the level of her scooter, causing the accident.
The plaintiffs claim that the resort did not have proper procedures for providing appropriate and/or safe conditions for guests, including on transportation vehicles. The handicapped lift was part of a tram used to transport guests with disabilities.
The Lucases claim in the lawsuit that Theresa suffered "serious bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment, and the loss of future earnings. The losses are permanent and continuing."
The plaintiffs request a trial by jury and seek judgment for damage, together with interest, costs, and for such other and further relief as the Court deems just and proper. They are represented by Jana R. Cortina of A Bales Professional Association in Tampa.
