Orlando property owner alleges insurance company failed to pay for hurricane damage

ORLANDO — An Orlando property owner is a licensed insurer, alleging breach of an insurance contract.

Toan Nguyen filed a complaint July 25 in Orange County Circuit Court against American Integrity Insurance Company of Florida, alleging failure to adequately indemnify the plaintiff for a loss due to a hurricane.

According to the complaint, on Sept. 12, 2017, while the American Integrity insurance policy was in full force and effect, Nguyen's property at 10280 Cline Ave., Orlando, sustained a covered loss as a result of wind, wind-driven rain, and/or hail from Hurricane Irma. 

Due to the defendant's breach, the suit says, Nguyen has suffered and continues to suffer damages. The plaintiff alleges American Integrity Insurance has failed to tender an appropriate amount to repair the plaintiff's property.

Nguyen seeks trial by jury, damages that exceed $15,000 exclusive of interest, costs and attorney’ fees. The plaintiff is represented by attorney Louis A. Gonzalez of Vargas Gonzalez Hevia Baldwin LLP in Winter Park.
