ORLANDO — An Orlando resident is suing an insurance company, alleging breach of an insurance contract.
Carlos Guffain filed a complaint July 25 in Orange County Circuit Court against Universal Insurance Company of North America, alleging the insurer failed to tender an appropriate amount to repair the plaintiff's property.
According to the complaint, on Jan. 1, Guffain's property at 8067 Nicklaus Drive, Orlando, sustained a covered loss as a result of wind, wind-driven rain, and/or hail. As a result of the defendant’s breach of the policy, Guffain says he has suffered and continues to suffer financial damages.
The plaintiff alleges Universal Insurance of North America has failed to adequately indemnify Guffain for the loss.
Guffain seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. He is represented by attorney Louis A. Gonzalez of Vargas Gonzalez Hevia Baldwin LLP in Winter Park.
