Motorist alleges another driver, State Farm failed to cover crash damages

CLEARWATER — A vehicle driver is suing an uninsured motorist and State Farm, alleging breach of contract and negligence.

David See II filed a complaint July 27 in Pinellas County Circuit Court against Michael Whitting and State Farm Mutual Automobile Insurance Co., alleging failure to fully compensate the plaintiff for the damages he sustained in a vehicle crash.

According to the complaint, on July 27, 2017, See was stopped at the 5th Avenue North ramp off Interstate Highway 275 in Pinellas County. The suit says his vehicle was struck from behind by Whiting's car, leading to serious and permanent injuries for the plaintiff. 

The suit alleges Whiting was underinsured for the damages sustained, and See made claims for an underinsured motorist from State Farm. However, the suit alleges, See did not receive compensation within 60 days as outlined in Florida statutes. 

The plaintiff alleges State Farm Mutual Automobile Insurance failed to comply with the insurance contract to provide underinsured motorist coverage to See despite his demands.

See seeks trial by jury, damages in excess of $15,000, plus costs, prejudgment interest at the statutory rate for actual out-of-pocket pecuniary losses, and attorney fees. He is represented by attorney Eric Nelsestuen of Nelsestuen Bayle Law Firm in Land O Lakes.
