FORT LAUDERDALE — A Plantation homeowner is suing an insurance company, alleging breach of contract.
Alina Levanti-Dorbuck filed a complaint July 17 in Broward County Circuit Court against Southern Oak Insurance Company, alleging the defendant breached the policy by failing to acknowledge coverage for the plaintiff's property loss.
According to the complaint, June 21, 2017, while Levanti-Dorbuck's Southern Oak policy was in full force and effect, her property at 1560 SW 52nd Ave., Plantation, sustained a covered loss as a result of water damage.
Despite the insurance company assigning a claim number to the loss, Levanti-Dorbuck alleges she was informed her claim was denied because it was not covered by the policy, although she says it was obvious that the sustained damage was covered.
The plaintiff alleges Southern Oak Insurance failed to acknowledge coverage for the loss, and/or acknowledge that payment would be forthcoming, or make any payment of insurance proceeds to the insured.
Levanti-Dorbuck seeks trial by jury, judgment that exceeds $15,000, plus court costs and attorney fees, and all other just and proper relief. She is represented by attorneys David Garcia and Anthony M. Lopez of Marin, Eljaiek, Lopez & Martinez, PL in Coconut Grove.
