Motorist alleges another driver caused Largo collision that led to injuries

CLEARWATER — A motorist and minor companion are suing another driver, alleging insufficient measures were taken to prevent injuries.

Rene Hernandez, and on behalf of Spencer Hernandez, a minor, filed a complaint July 10 in Pinellas County Circuit Court against Austin A. Metzenroth, alleging the driver negligently operated and/or maintained a motor vehicle, resulting in a collision.

According to the complaint, on Sept. 9 2017, Hernandez and his son were driving along Ulmerton Road and 113th Street North in Largo. The suit says Metzenroth, negligently operating a motor vehicle, collided with the plaintiffs' vehicle. 

As a result, the lawsuit states, Rene and Spencer Hernandez,suffered bodily injuries resulting in pain, disability, disfigurement, mental anguish, expense of hospitalization, medical care and treatment and damage to property. 

The plaintiffs allege Metzenroth negligently operated and/or maintained a motor vehicle and failed to exercise reasonable care, causing a collision and a dangerous condition to other motorists.

Rene and Spencer Hernandez seek trial by jury, damages in excess of $15,000, plus costs, interest, attorney fees and all other just and proper relief. They are represented by attorneys James S. Jenkins III and Ashley Ward-Singleton of Jenkins Law PL in St. Petersburg.
