ORLANDO — A construction company is suing an Orange County restaurant/coffee shop and owner, alleging refusal to apply payments of more than $34,000 and unjust enrichment.

Hanson Construction Inc. filed a complaint June 22, in Orange County Circuit Court against Tutto Caffe LLC and Antony C. Frith, alleging failure to pay for services rendered.

According to the complaint, on July 6, 2017, Hanson Construction entered into an oral contract with the defendants to construct and build a restaurant/coffee shop at 4833 New Broad St., Orlando. Hanson Construction performed all the terms and completed the work, the suit says.

However, the lawsuit states, Tutto Caffee and Frith have failed and refused to remit the outstanding balance of $34,758.74. As a result, Hanson Construction has been damaged at the very least in $34,758.74, the suit says.

Hanson Construction seeks trial by jury, damages of at least $34,758.74, plus costs of suit, prejudgment interest, attorney fees and any other further relief the court deems proper. It is represented by attorneys Christian H. Tiblier and David C. Willis of Rumberger Kirk & Caldwell in Orlando.
