An Orlando couple is suing an insurance company, alleging refusal to pay for hurricane damage

ORLANDO — Two Orlando property owners are suing an insurer, alleging breach of contract for refusal to apply payments for hurricane damages.

Kenneth Bettam and Margaret Bettam filed a complaint June 12 in Orange County Circuit Court against Avatar Property and Casualty Insurance Company, alleging failure and refusal to pay full coverage of a covered loss.

According to the complaint, on Sept. 10, 2017, the Bettams' property at 2418 Albion Ave., Orlando, suffered damages from Hurricane Irma, a covered loss. The suit says the policy was in full force and effect and all conditions precedent were complied with. 

The Bettams say they made a timely claim for the damages, but Avatar has failed and continues to refuse to fully pay for the covered loss. As a result, the Bettams say they have suffered and continue to suffer damages and expenses for repair and maintenance. 

The Bettams seek trial by jury, damages that exceed $15,000, exclusive of interest, court costs, attorney fees and all such other relief the court deems appropriate. They are represented by attorneys Andrew P. McDonald and David D. Barnhill of McDonald & Barnhill, PA in Tampa.
