Guest alleges Walt Disney negligence led to injuries

ORLANDO — A Lake County woman is suing Disney's Hollywood Studios, alleging negligence led to injuries to the plaintiff.

Hilda Fitzgerald filed a complaint May 25 in Orange County Circuit Court against Walt Disney Parks and Resorts US Inc., doing business as Disney's Hollywood Studios, alleging the amusement park failed to follow applicable safety guidelines and regulations.

According to the complaint, on Oct. 18, 2016, while Fitzgerald was walking in a designated area of Disney Hollywood Studios, an unknown person negligently operated the motorized wheelchair that struck the plaintiff. Fitzgerald says this caused severe injuries and resulting pain and suffering, disability, disfigurement, mental anguish, loss of earnings and aggravation of a previously existing condition. 

The plaintiff alleges Disney's Hollywood Studios entrusted the motorized EVC to the unknown user, failed to inspect and/or repair the motorized EVC for any defects in the equipment, and failed to adequately warn invitees of the dangerous condition.

Fitzgerald seeks trial by jury, damages, costs of action, and all other relief the court deems just. She is represented by attorneys Gregory P. Smith and John R. Oldham of Oldham & Smith PL in Tavares.
