Customer blames 7-Eleven store for injuries

ORLANDO — A Seminole County man is suing a 7-Eleven store, alleging negligence.

Judd Webster filed a complaint March 19 in Orange County Circuit Court against 7-Eleven Inc. and Pepsico Inc., alleging they failed to follow applicable safety guidelines and regulations.

According to the complaint, on Dec. 27, 2017, Webster was a customer at the 7-Eleven store at 8510 S. U.S. Highway 17-92 in Fern Park. The suit says a floor mat near the entrance had been disturbed by a delivery from Pepsico, and that Webster's foot caught on the upturned portion of the mat, causing him to fall to the floor.

Webster says he sustained bodily injuries, resulting in pain and suffering, disability, disfigurement, aggravated a preexisting condition, mental anguish, and leading to a loss of earnings, due to the defendants' negligence. 

The plaintiff alleges the defendants failed to provide Webster a safe floor that was clear of hazards, and failed to correct the condition or warn the user of the hazardous condition.

Webster seeks trial by jury, judgment in excess of $15,000, exclusive of court costs and interest. He is represented by attorneys Richard B. Troutman and Matthew R. Boren of The Law Offices of Richard B. Troutman PA in Winter Park.
