Couple says Tower Hill Preferred Insurance Company didn't pay legitimate claim

CLEARWATER — A couple filed a class-action lawsuit against an insurance company, citing alleged breach of contract.

Raymond and Kathleen Vicari filed a complaint on March 13 in the 6th Judicial Circuit of Florida-Pinellas County against Tower Hill Preferred Insurance Company alleging that it breached a contract by refusing to comply with required agreements.

According to the complaint, the Vicaris allege that on Sept. 10, 2017, they notified the defendant of the damages their insured property suffered after a problem. Tower Hill claims it has complied with all conditions precedent to entitle the Vicaris to recover under the policy, but it allegedly failed to pay for all losses sustained. 

The plaintiffs hold Tower Hill Preferred Insurance Company responsible because it allegedly refused to pay for all losses covered under an insurance policy.

The plaintiffs request a trial by jury and seek judgment for all covered losses with interest on any overdue payments, attorney's fees and costs. They are represented by Jeffrey Constantinos of Morgan & Morgan, PA in Tampa.
