Orlando property owners allege insurance company failed to cover water damage

ORLANDO — Two Orlando homeowners are suing an insurance company, alleging breach of an insurance policy contract in failing to cover water damage.

Alexis Vargas and Luznery Vargas filed a complaint Jan. 16 in Orange County Circuit Court against Castle Key Insurance Company, alleging the defendant failed to provide payment of all premiums due and owing as were written in the policy.

According to the complaint, on June 12, 2017, while their policy with Castle Key was in full force and effect, the Vargas property at 127 Cosmos Drive, Orlando, sustained a covered loss of as a result of water damage. The suit says despite the Vargases reporting the loss, making the property available for inspection and cooperating with the defendant's investigation of the loss, the plaintiffs were denied insurance benefits covered under the policy. 

The plaintiffs allege Castle Key Insurance failed to acknowledge that payment would be forthcoming, and/or make any payment of insurance proceeds.

The Vargases seek trial by jury, damages of more than $15,000, plus costs and attorney fees, and all other relief the court deems just and proper. They are represented by attorney David D. Gongora of Law Office of David D. Gongora, PA in Orlando.
