Patron sues Walt Disney resort, claims employee struck him

CLEARWATER — A patron is accusing a public facility of negligence by creating a dangerous condition in its premises.

Dobert Thompson filed a complaint on Jan. 16 in the 9th Judicial Circuit Court of Florida-Orange County against Walt Disney Parks and Resorts US, Inc. alleging that it breached its duty to use a reasonable amount of care in the operation of its premises.

According to the complaint, Thompson alleges that on March 24, 2014, while he was a patron at the defendant's Magic Kingdom resort, he was struck by an employee while sitting in a wheelchair.

As a result, Thompson claims, he sustained bodily injuries, suffered physical handicap and disfigurement, and incurred hospital and medical expenses. 

The plaintiff holds Walt Disney Parks and Resorts US, Inc. responsible because it allegedly failed to provide a safe environment for invitees, failed or neglect to give warning of the latent or unrevealed dangers of the property and failed to properly train and/or supervise its employees.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $15,000, exclusive of costs and interest. He is represented by Eduardo R. Latour of Latour & Associates, PA in Tarpon Springs.
