Delivery man claims dangerous dog attacked him

ORLANDO — A man is accusing a dog owner of not properly supervising his dog to avoid an attack.

Roberto Roche filed a complaint on Jan. 16 in the 9th Judicial Circuit Court of Florida against Gordon H. Harris alleging that the defendant failed to know that his dog living on his property was dangerous with a propensity to attack.

According to the complaint, the plaintiff alleges that on Jan. 20, 2017, while delivering a package to 1500 Bonnie Burn Circle in Winter Park, he was attacked and bitten by Harris' dog. The dog was allegedly allowed to roam free without supervision. 

As a result, Roche claims he suffered bodily injuries, physical impairment, mental anguish and expense of hospitalization. 

The plaintiff holds Harris responsible because he allegedly failed to control and supervise his dog, failed to warn of the dangerous and hazardous propensity of the dog, and failed to determine whether the dog was dangerous before allowing to reside on the property.

The plaintiff requests a trial by jury; and seeks judgment for damages in excess of $15,000 with costs, attorneys' fees and such other relief deemed proper by the court. He is represented by Ryan Christopher Rodems of Morgan & Morgan, PA in Orlando.
