Woman files suit against Wickham Park Homeowners Association over fall allegedly caused by sprinkler head

ORLANDO – A Polk County woman alleges the negligence of a landscaping company and others caused her to fall at a rental property.

Kathleen Listen filed a complaint on Nov. 30 in the 9th Judicial Circuit Court of Florida - Orange County against Wickham Park Homeowners Association Inc., Platinum Landscaping and Andrew Santelli, alleging negligence.

According to the complaint, Listen alleges that on June 3, 2016, she was visiting her daughter at a Windermere rental property when she tripped and fell on a sprinkler head.

The plaintiff alleges the defendants failed to maintain and correct the unreasonably dangerous condition of the sprinkler head on the premises, failed to warn invitees of the danger of the sprinkler head and failed to have adequate staff on duty or assigned to the task of inspecting the premises for the dangerous condition.

The plaintiff seeks judgment for damages of more than $15,000 exclusive of interest, costs, attorneys' fees and such relief deemed proper by the court. She is represented by Lina M. Lopez of Morgan & Morgan PA in Orlando.
