Maitland homeowners allege insurer fails to cover wind damage

ORLANDO — A Maitland couple is suing an insurer, alleging breach of contract.

Frank Gainey Jr. and Ida Gainey filed a complaint Dec. 8 in Orange County Circuit Court against American Integrity Insurance Company, alleging failure to cover wind damages. 

According to the complaint, on March 26, 2016, while the policy for the Gaineys'' property at 1662 Bobtail Drive, Maitland. was in full force and effect, their home sustained water damage as a result of a windstorm. However, the suit says, American Integrity has refused to fully compensate the plaintiffs for their loss. 

The plaintiffs allege American Integrity Insurance failed to provide coverage for the loss, failed to acknowledge that additional payment would be forthcoming and has failed to adequately provide coverage under the terms of the policy.

The Gaineys seek trial by jury, damages of more than $15,000, declaratory relief, attorney fees and all other relief the court deems appropriate. They are represented by attorney Alexandra Ramon of Ramon, Rodriguez, Blanco-Herrera LLP in Miami.
