Customer accuses boat steering mechanism manufacturer of negligence

CLEARWATER — An Oklahoma man is suing the manufacturer of a boat steering mechanism, alleging product liability.

Richard J. Cody filed a complaint Nov. 15 in Pleasants Circuit Court against BRP US, Inc. alleging manufacturing of a defective Spark boat steering device, causing injuries to users.

According to the complaint,on Aug. 28, 2016, Cody was operating a Sea Doo Spark manufactured by BRP US. in waters south of Honeymoon Island Causeway. The suit says when Cody's Spark crossed the wake of another vessel, it became airborne and the Spark's steering mechanism completely broke. 

The lawsuit states Cody struck the Spark and was ejected into the path of another BRB watercraft.  As a result, Cody says he suffered significant permanent injuries and incurred medical expenses for surgeries and other medical care. Cody says he will require further surgery. 

The plaintiff alleges BRP US designed a faulty handle bar/steering column and failed to warn users of the risks posed by the Spark boat.

Cody seeks trial by jury, more than $15,000 for punitive damages, and all further relief the court deems just. He is represented by attorneys Robert S. Jones, II and Heath C. Murphy of The Law Offices of Bobby Jones, PA in St. Petersburg.
