Customer blames department store for head injuries

ORLANDO — A customer is suing an Orange County outlet store, alleging negligence led to the plaintiff getting struck in the head by a rolled carpet.

Ruth Diane Velasquez filed a complaint Nov. 28 in Orange County Circuit Court against Ollies's Bargain Outlet, Inc., alleging failure to maintain its premises in a safe condition.

According to the complaint, on Dec. 12, 2016, Velasquez was a lawful invitee at the Ollie's department store at 942 Semoran Blvd., Casselberry. The suit says Velasquez was struck in the head by a rolled-up carpet that was negligently leaning up against the partition between checkout lines. 

The lawsuit states the force of the falling carpet was so great that it knocked Velasquez on the floor. As a result, she says, she suffered bodily injury, mental anguish, loss of capacity for the enjoyment of life, lost the ability to earn money and incurred medical and treatment expenses. 

The plaintiff alleges Ollies's Bargain Outlet failed to adequately keep checkout isles clear of any hazardous objects and failed to warn customers of the dangerous condition that existed in the store.

Velasquez seeks trial by jury, damages and judgment in excess of $15,000, interest and costs of court. She is represented by attorney Mark R.Ahrens of Todd K.Miner, PA in Orlando.
