Policyholder alleges Liberty Mutual failed to cover water damage

ORLANDO — A Kissimmee property holder is suing Liberty Mutual, alleging breach of contract.

Richard Miller filed a complaint Nov. 15 in Orange County Circuit Court against Liberty Mutual Fire Insurance Company, alleging the defendant breached good faith and fair dealing in failing to cover water damage.

According to the complaint, on June 6,  while Liberty Mutual's insurance of Miller's property at 2705 Star Grass Circle, Kissimmee, was in full force, the property sustained a covered loss due to water damage. Although, the suit says Liberty Mutual acknowledged coverage for the loss, the amount of insurance benefits has not been sufficient to fully repair the property. 

The plaintiff alleges Liberty Mutual Fire Insurance has failed to acknowledge or deny that further payment would be forthcoming, and has failed to make any further payment of insurance proceeds to the insured.

Miller seeks trial by jury, damages of more than $15,000, additional insurance proceeds in the correct amount of the loss, plus interest, court costs and attorney fees. He is represented by attorney S. Antonio Jimenez of Diverse Legal Solutions in Miramar.
