CLEARWATER — A Clearwater property owner is suing an insurance company, alleging breach of contract.
Cesar Robalino filed a complaint Nov. 16 in Pinellas County Circuit Court against Homeowners Choice Property & Casualty Insurance Company Inc., alleging failure to cover insured property damage.
According to the complaint, on Aug. 4, 2015, Robalino suffered loss on his insured property at 2490 Burnice Drive, Clearwater, due to a leak in the roof. Although covered by the terms of the Homeowners Choice insurance policy, the suit says, Robalino has not received his full benefits due under the policy.
The plaintiff alleges Homeowners Choice Property & Casualty Insurance has failed to pay for the damages that are covered under the policy and failed to honor its contractual obligation for the loss and claim.
Robalino seeks trial by jury, damages of more than $15,000, court costs, prejudgment interest and attorney fees. He is represented by attorneys Jonathan Drake and Manuel L. Iravedra of Strems Law Firm in Tampa.
