Driver alleges another motorist's negligence caused crash

CLEARWATER — A Pinellas County woman is suing a motorist, alleging the defendant's negligence caused a crash that injured the plaintiff.

Pamela Hern filed a complaint Oct. 24 in Pinellas Circuit Court against William Sutton, alleging the motorist failed to exercise standard care and skill required in operating a vehicle.

According to the complaint, on Jan. 1, 2017, Hern was driving her Chevrolet on Gulf to Bay Boulevard in Clearwater when Sutton's vehicle collided with hers. The suit says Hern suffered bodily injury, pain and suffering, disability, disfigurement, mental anguish, medical expenses, loss of earnings and aggravation of a previously existing injury as a result of Sutton's negligence. 

The plaintiff alleges Sutton failed to adequately maintain and operate a motor vehicle so as not to cause harm, and failed to be on a proper lookout for other vehicles.

Hern seeks trial by jury, damages in excess of $15,000, plus court costs and fees. She is represented by attorney William H. Winters of Winters & Yonker in Tampa.
