ORLANDO — A Maitland homeowner is suing an insurance company, alleged breach of contract in failing to cover damages to her home.
Carmen Falu-Tejada filed a complaint Oct. 10 in Orange County Circuit Court against Monarch National Insurance Company, alleging the insurer breached its duty of good faith and fair dealing in covering damages to her home.
According to the complaint, Falu-Tejada's dwelling at 100 Lakewind Trail, Maitland, was damaged while its insurance policy was in full force and effect. However, the suit says, Monarch has refused to pay for all of plaintiff’s losses, despite her compliance with all conditions precedent to entitle her to recover under the policy.
The plaintiff alleges Monarch National obligated her to retain the services of an attorney to protect her interest, and has refused to pay for all of her losses.
Falu-Tejada seeks trial by jury, damages and repairs of more than $15,000, attorney fees and court costs. She is represented by attorney Abou Maaroufi of The Nation Law Firm LLP in Longwood.
