Customer blames store for fall, injuries

ORLANDO — An Orange County customer is suing an Orlando property owner, alleging negligence in having an inappropriate flooring surface, which caused injuries.

Bartolo Colon filed a complaint Sept. 19 in the Ninth Judicial Circuit Court of Florida Orange County against WAWA, Inc., the defendant failed to maintain and keep its premises in a reasonably safe condition.

According to the complaint, on Dec. 3, 2016, Colon was a customer who was lawfully in the defendant's store at 3100 S. Orange Ave., Orlando, when he slipped and fell on a liquid substance, which had accumulated on the floor. As a result, says he suffered pain and suffering, physical injuries, medical expenses and loss of enjoyment of life. 

The plaintiff alleges WAWA failed to properly maintain and inspect its floors and premises and failed to provide adequate warnings in writings or other reasonable notice of the unsafe, dangerous and hazardous condition.

Colon seeks trial by jury, compensatory damages of more than $15,000, exclusive of interest and costs of court. He is represented by attorney Joseph Abdallah of Kanner & Pintaluga PA in Boca Raton.
