Customer blames Largo theater owner for injuries

CLEARWATER — A moviegoer is suing a Largo movie theater owner and a fire extinguisher supplier, alleging negligence led to injuries for the plaintiff.

Franklin Kelley filed a complaint Sept. 18 in Pinellas County Circuit Court against Regal Cinemas, Inc and Piper Fire Protection Inc., alleging failure to maintain the premises in a reasonably safe condition.

According to the complaint, on March 10, Kelley was at defendants' property, 10500 Ulmerton Road E., Largo, as a business invitee when a fire extinguisher fell on him. As a result of the incident, Kelley says, he suffered bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life and hospital and medical expenses. 

The plaintiff alleges the defendants negligently allowed a dangerous conditions to remain on the premises in the form of a negligently installed and/or maintained fire extinguisher.

Kelley seeks trial by jury, damages in excess of $15,000, plus court costs. He is represented by attorney Christopher M. Reynolds of Corless Barfield Trial Group in Tampa.
